Vorbehaltlich der Zahlung der jeweils anfallenden Gebühr wird RIM CHOP („die Software“) an dich lizenziert — nicht verkauft — zur Nutzung im von dir gewählten Tarif (Free, Monatlich, Jährlich oder Season — der Founder-Tarif ist ein vergünstigtes erstes Jahr des Jahresabos). Eine Lizenz gilt für einen einzelnen Nutzer; die Zahl der Geräte, die du aktivieren darfst, entspricht der für deinen Tarif angezeigten Zahl und wird vom Lizenzsystem durchgesetzt. Die Software darf für kommerzielle Arbeiten genutzt werden. Du darfst die Software nicht weiterverkaufen, unterlizenzieren, vermieten oder weiterverbreiten.
Der Free-Tarif und die 20-tägige Vollversions-Testphase werden „wie besehen“ zur Evaluierung bereitgestellt. Im Free-Tarif erzeugte Ausgaben können ein Wasserzeichen und/oder eine Kamera-Begrenzung tragen, wie auf der Website beschrieben.
Abonnements (Monatlich und Jährlich, einschließlich des Founder-Tarifs für das erste Jahr) verlängern sich bis zur Kündigung; der Season-Pass umfasst 6 Monate und verlängert sich nicht automatisch. Verkauf, Umsatzsteuer und Auszahlungen werden von unserem Merchant of Record Lemon Squeezy abgewickelt, der als Verkäufer (Seller of Record) auftritt und deine Rechnung ausstellt.
Da die Software als digitaler Inhalt sofort bereitgestellt wird, stimmst du — mit dem Start des Downloads oder der Lizenzaktivierung — der sofortigen Bereitstellung zu und verzichtest damit auf dein 14-tägiges Rücktrittsrecht gemäß dem österreichischen FAGG (§ 18 Abs. 1 Z 11). Um die Software vorab zu evaluieren, nutze den Free-Tarif und die 20-tägige Vollversions-Testphase. Gesetzliche Gewährleistungsrechte bleiben unberührt; darüber hinaus sind Käufe nicht erstattungsfähig, außer wo gesetzlich vorgeschrieben.
Du darfst die Software nicht zurückentwickeln (Reverse Engineering), dekompilieren oder disassemblieren, ihre Lizenzprüfung umgehen oder sie rechtswidrig nutzen.
RIM CHOP enthält das Blackmagic RAW SDK und das RED R3D SDK. Mit der Nutzung von RIM CHOP stimmst du zusätzlich zu, dass du nicht:
RIM CHOP ist ein eigenständiges Produkt und steht in keiner Verbindung zu, wird nicht unterstützt, zertifiziert oder gewährleistet von Blackmagic Design oder RED Digital Cinema. „Blackmagic RAW“ ist eine Marke von Blackmagic Design Pty. Ltd.; „RED“, „REDCODE“ und „R3D“ sind Marken von RED.COM, LLC. Alle weiteren Marken sind Eigentum der jeweiligen Inhaber.
Die Software wird „WIE BESEHEN“ bereitgestellt, ohne jegliche Gewährleistung, im größtmöglichen gesetzlich zulässigen Umfang. Wir gewährleisten nicht, dass sie fehlerfrei oder für einen bestimmten Zweck geeignet ist.
Soweit gesetzlich zulässig, haften wir nicht für indirekte, beiläufige oder Folgeschäden oder für verlorene Daten, entgangenen Gewinn oder verlorenes Filmmaterial, die aus der Nutzung der Software entstehen. Die zwingende gesetzliche Haftung (z. B. für grobe Fahrlässigkeit oder Personenschäden) bleibt unberührt.
Wir können die Software und diese Bedingungen aktualisieren. Wesentliche Änderungen werden per E-Mail und/oder durch einen Hinweis in der App mitgeteilt.
Diese Bedingungen unterliegen dem Recht Österreichs unter Ausschluss seiner Kollisionsnormen und des UN-Kaufrechts (CISG). Soweit rechtlich zulässig, ist Gerichtsstand das zuständige Gericht in Österreich. Bist du Verbraucher, bleiben die zwingenden Verbraucherschutzbestimmungen deines Staates des gewöhnlichen Aufenthalts unberührt.
Subject to payment of the applicable fee, RIM CHOP (“the Software”) is licensed — not sold — to you for use under the tier you choose (Free, Monthly, Yearly or Season — the Founder rate is a discounted first year of Yearly). A licence is for a single user; the number of devices you may activate is the number shown for your tier and is enforced by the licence system. The Software may be used for commercial work. You may not resell, sublicense, rent or redistribute the Software.
The Free tier and the 20-day full trial are provided as-is for evaluation. Output produced under the Free tier may carry a watermark and/or camera limit as described on the site.
Subscriptions (Monthly and Yearly, including the Founder first-year rate) renew until cancelled; the Season pass covers 6 months and does not auto-renew. Sales, VAT and payouts are handled by our merchant of record Lemon Squeezy, who is the seller of record and issues your invoice.
Because the Software is digital content delivered immediately, you agree — by starting the download or licence activation — to immediate provision and thereby waive your 14-day right of withdrawal under the Austrian FAGG (§ 18 Abs. 1 Z 11). To evaluate the Software beforehand, use the free tier and the 20-day full trial. Statutory warranty rights remain unaffected; beyond that, purchases are non-refundable except where required by law.
You may not reverse engineer, decompile or disassemble the Software, circumvent its licence check, or use it unlawfully.
RIM CHOP incorporates the Blackmagic RAW SDK and the RED R3D SDK. By using RIM CHOP you additionally agree that you will not:
RIM CHOP is an independent product and is not affiliated with, endorsed, certified or guaranteed by Blackmagic Design or RED Digital Cinema. “Blackmagic RAW” is a trademark of Blackmagic Design Pty. Ltd.; “RED”, “REDCODE” and “R3D” are trademarks of RED.COM, LLC. All other trademarks are the property of their respective owners.
The Software is provided “AS IS”, without warranty of any kind, to the fullest extent permitted by law. We do not warrant that it will be error-free or fit for a particular purpose.
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for lost data, profits or footage arising from use of the Software. Mandatory statutory liability (e.g. for gross negligence or personal injury) remains unaffected.
We may update the Software and these terms. Material changes will be communicated by email and/or by an in-app notice.
These terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent legally permissible, the place of jurisdiction is the competent court in Austria. If you are a consumer, the mandatory consumer-protection provisions of your country of habitual residence remain unaffected.
